Terms & Conditions and Cancellations
These Terms & Conditions and Cancellations (“Terms”) apply to all tours, activities, reservations, transportation services, private tours, group tours, and related services offered by Haleakalā EcoTours, a DBA of Haleakala Bike Company Incorporated (“Haleakalā EcoTours,” “we,” “us,” or “our”).
By making a reservation or participating in a Haleakalā EcoTours activity, you acknowledge that you have read, understood, and agreed to these Terms.
Reservations and Payment
All reservations must be made through an authorized Haleakalā EcoTours booking channel.
Reservations are subject to availability and are not guaranteed until the reservation has been confirmed.
Unless otherwise stated at the time of booking, reservations are paid in full at the time of booking.
Prices may be subject to applicable taxes, fees, transportation charges, or other charges disclosed during the reservation process.
A reservation confirmation will provide the applicable tour date, time, meeting or pickup information, and other important instructions.
Guests are responsible for reviewing their confirmation and contacting Haleakalā EcoTours promptly if any reservation information is incorrect.
Tour Availability
Haleakalā EcoTours offers guided vehicle and nature tours throughout Maui, including tours of Haleakalā National Park, Upcountry Maui, the Road to Hāna, and other destinations.
Tours may include sunrise, daytime, sunset, rainforest, Road to Hāna, private, and group experiences.
Tour routes, stops, schedules, transportation arrangements, and activities may vary depending on weather, road conditions, park regulations, closures, traffic, safety considerations, availability, and other circumstances outside our control.
Haleakalā EcoTours reserves the right to modify the itinerary when reasonably necessary to protect the safety and well-being of guests, guides, drivers, or others.
Haleakalā National Park
Haleakalā EcoTours is an authorized concessioner of the National Park Service and is authorized to provide guided road tours and interpretive services within Haleakalā National Park.
Access to portions of Haleakalā National Park may be affected by park regulations, closures, weather, road conditions, capacity restrictions, emergency conditions, government decisions, or other circumstances outside the control of Haleakalā EcoTours.
Guests must comply with all applicable National Park Service rules, instructions from Haleakalā EcoTours guides and drivers, and other safety requirements.
Haleakalā EcoTours cannot guarantee access to any particular location, viewpoint, trail, attraction, or park area.
Guest Responsibilities
Guests are responsible for arriving at the designated meeting location or being ready for pickup at the scheduled time.
Guests must follow all instructions provided by Haleakalā EcoTours employees, guides, and drivers.
Guests are expected to behave respectfully toward other guests, employees, local communities, cultural sites, wildlife, and the natural environment.
Guests may be refused participation or removed from a tour if their behavior creates a safety concern, significantly interferes with the experience of other guests, or violates applicable rules or instructions.
No refund will necessarily be provided when a guest is removed from an activity because of inappropriate, unsafe, disruptive, or unlawful behavior.
Pickup and Transportation
Where transportation or hotel pickup is included with a tour, pickup locations and times will be provided during the reservation process or in the reservation confirmation.
Guests are responsible for providing accurate hotel, accommodation, contact, and pickup information.
Guests should be ready at the designated pickup location at least several minutes before the scheduled pickup time.
Delays may occur because of traffic, weather, road conditions, other guests, park access, or other circumstances.
Haleakalā EcoTours is not responsible for missed tour participation resulting from a guest providing incorrect pickup information, failing to be ready at the designated location, or failing to respond to reasonable attempts to contact the guest.
Cancellations by Guests
All cancellations must be communicated to Haleakalā EcoTours before the applicable cancellation deadline.
Standard Reservations
Cancellations made more than 48 hours before the scheduled activity date may be eligible for a refund in accordance with the applicable reservation terms.
Cancellations made within 48 hours of the scheduled activity date will not be eligible for a refund and will be charged 100% of the activity price.
No-Shows
No refunds will be issued for guests who do not appear for their scheduled activity or who fail to arrive at the designated meeting or pickup location on time.
A failure to appear, failure to respond to pickup attempts, or failure to provide accurate pickup information may be treated as a no-show.
Private Tours
Private tours must be canceled at least 7 days prior to the scheduled activity date.
If a private or group booking is canceled after the applicable 7-day deadline, no refund will be issued.
Private-tour cancellation terms may also be stated in the applicable reservation confirmation or private-tour agreement.
Medical Cancellations
Cancellations for medical reasons may be eligible for a refund at the discretion of management.
Haleakalā EcoTours may require appropriate documentation, such as a doctor’s note, before considering a medical cancellation.
Medical cancellations do not automatically guarantee a refund.
Refund determinations are made on a case-by-case basis.
Cancellations or Changes by Haleakalā EcoTours
Haleakalā EcoTours may cancel, postpone, modify, shorten, or change an activity when reasonably necessary.
Reasons may include, but are not limited to:
- Inclement or hazardous weather
- Road closures or hazardous road conditions
- National Park closures or restrictions
- Natural disasters
- Government restrictions or requirements
- Safety concerns
- Lack of participation
- Vehicle or equipment issues
- Resource or staffing requirements
- Traffic or transportation conditions
- Other circumstances outside the reasonable control of Haleakalā EcoTours
The safety of our guests and employees is our highest priority.
Weather-Related Cancellations
Maui’s weather can vary significantly between locations and elevations.
Rain, wind, clouds, fog, temperature changes, and other normal weather conditions do not necessarily result in a tour cancellation.
If Haleakalā EcoTours determines that weather or other conditions make an activity unsafe or impractical, we may cancel or modify the activity.
When an activity is canceled by Haleakalā EcoTours before services have been provided, guests will generally be offered the opportunity to reschedule.
If a guest is unable to reschedule, a full refund may be issued on a case-by-case basis, subject to the circumstances of the cancellation and applicable reservation terms.
Modified or Shortened Activities
Haleakalā EcoTours may modify, shorten, or change an itinerary because of weather, road conditions, closures, safety concerns, park restrictions, or other circumstances.
We will make reasonable efforts to provide an experience that is comparable to the original itinerary when possible.
If the company significantly modifies an activity and the modification results in a lower-value activity, the applicable difference in purchase price may be refunded.
If transportation or tour services have already been provided before an activity is significantly modified or canceled, a service fee of up to 50% of the applicable purchase price may be retained to cover services already provided.
Any remaining eligible balance may be refunded.
Refunds under this section are determined based on the circumstances of the individual reservation.
Guest Decision Not to Participate
Guests may choose not to participate in an activity at any time.
Guests are encouraged to notify their guide or Haleakalā EcoTours as soon as possible if they do not feel comfortable participating.
If a guest voluntarily chooses not to participate for personal reasons, a refund is not guaranteed.
Guests who decline participation before services are provided may request a refund, which will be considered by management on a case-by-case basis.
Once transportation or other tour services have been provided, refunds may be limited or unavailable.
Tour Content and Itinerary
Tour descriptions, photographs, schedules, and itineraries on the website are provided for general informational purposes.
Actual tour experiences may vary.
Haleakalā EcoTours does not guarantee that guests will see a particular sunrise, sunset, wildlife species, weather condition, landscape, viewpoint, waterfall, road condition, or other specific feature.
Natural conditions and circumstances on Maui can change quickly.
Road closures, park restrictions, traffic, weather, construction, emergencies, and other conditions may require changes to the advertised itinerary.
Sunrise Tours
Sunrise tours to Haleakalā involve travel to high elevation and may involve significant temperature differences from sea level.
Guests should dress appropriately and follow all instructions provided by their guide.
Access to the summit area may be affected by National Park Service requirements, weather, road conditions, or other restrictions.
Haleakalā EcoTours does not guarantee a visible sunrise.
Cloud cover, fog, rain, wind, or other natural conditions may prevent guests from seeing the sunrise.
A lack of visibility due to normal weather conditions does not automatically qualify for a refund.
Health, Fitness, and High Elevation
Some Haleakalā EcoTours activities involve travel to high elevations and changing environmental conditions.
Guests are responsible for determining whether they are physically capable of participating in the selected activity.
Guests should consult a qualified medical professional if they have concerns about whether high elevation, temperature changes, long periods of vehicle travel, or other conditions may affect their ability to participate safely.
Guests should notify Haleakalā EcoTours in advance of any accessibility requirements or special needs so that reasonable arrangements can be discussed.
Haleakalā EcoTours does not provide medical advice.
Children and Minors
Children may participate in certain Haleakalā EcoTours activities subject to the age requirements and restrictions applicable to the selected tour.
A parent or legal guardian is responsible for minors participating in a tour.
Parents and guardians are responsible for ensuring that children follow all safety instructions and remain under appropriate supervision.
Specific age requirements may vary by activity.
Personal Belongings
Guests are responsible for their personal belongings during the tour.
Haleakalā EcoTours is not responsible for lost, stolen, damaged, or misplaced personal property unless otherwise required by law.
Guests should avoid bringing valuable or unnecessary items on the tour.
Photography and Media
Haleakalā EcoTours or its representatives may photograph or record tours, events, guests, or activities for marketing, educational, promotional, or operational purposes.
Where required by law, appropriate consent will be obtained.
Guests who do not wish to appear in promotional photography or video should notify Haleakalā EcoTours.
Assumption of Risk and Waivers
Participation in outdoor tours involves inherent risks, including but not limited to:
- Changing weather
- High elevation
- Uneven or natural terrain
- Road and transportation conditions
- Vehicle travel
- Slippery or wet surfaces
- Falling objects or natural hazards
- Wildlife
- Temperature changes
- Delays or changes caused by natural conditions
- Other risks associated with outdoor activities and travel
Guests may be required to review and sign applicable waivers, releases, acknowledgments, or other participation documents before taking part in an activity.
The applicable waiver and participation documents may contain additional terms concerning risks, releases, and limitations of liability.
Limitation of Liability
To the maximum extent permitted by applicable law, Haleakalā EcoTours and Haleakala Bike Company Incorporated shall not be responsible for losses, delays, expenses, injuries, damages, or other claims resulting from circumstances outside our reasonable control, including weather, road closures, government restrictions, park closures, traffic, natural disasters, or other unforeseen events.
Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.
Force Majeure
Haleakalā EcoTours shall not be liable for failure or delay in providing services caused by circumstances beyond its reasonable control.
Such circumstances may include:
- Severe weather
- Natural disasters
- Wildfires
- Flooding
- Earthquakes
- Road closures
- Government orders
- National Park restrictions or closures
- Public emergencies
- Labor disruptions
- Transportation disruptions
- Vehicle or infrastructure failures
- Other unforeseen events
When such circumstances occur, Haleakalā EcoTours may reschedule, modify, shorten, or cancel an activity.
Refunds
Refunds are subject to these Terms and the terms presented during the booking process.
Where a refund is approved, processing time may vary depending on the payment method and financial institution.
Haleakalā EcoTours is not responsible for delays imposed by banks, credit-card companies, payment processors, or other financial institutions.
Refunds may be issued to the original payment method unless otherwise agreed.
Third-Party Booking Platforms
Some reservations may be processed through third-party booking platforms or service providers.
Additional terms may apply to reservations made through those providers.
In the event of a conflict between these Terms and a specific booking platform’s terms, the terms disclosed to the guest at the time of booking may apply to the applicable transaction.
Guests are encouraged to review the terms provided during the reservation process.
Changes to These Terms
Haleakalā EcoTours may update these Terms from time to time.
When changes are made, the “Last Updated” date will be revised.
Updated Terms will become effective when posted on the website unless otherwise stated.
The Terms in effect at the time of your reservation will generally apply to that reservation, except where changes are required by law or necessary to address safety or operational matters.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws applicable to the State of Hawaii, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute arising from these Terms or services provided by Haleakalā EcoTours shall be subject to the jurisdiction of the appropriate courts in Hawaii, unless otherwise required by applicable law.
